This Privacy Policy describes how Forthwell Pay ("Forthwell", "we", "us") handles information when a business customer of a sponsoring bank ("Bank Partner") accesses the Forthwell Pay platform. Forthwell Pay provides software to Bank Partners; the Bank Partner is the provider of any banking, deposit, or payment services and its own privacy notice also applies to your relationship with the bank.
1. Who controls your data
For information you or your bank submit to operate the platform (invoices, clients, payments), Forthwell Pay generally acts as a service provider / processor to the Bank Partner. The Bank Partner is the controller of that information under most privacy laws. For information about your use of the marketing website, Forthwell Pay acts as controller.
2. Information we collect
- Account information: name, business name, business email, role.
- Invoicing and payments data: clients, invoices, estimates, payment records, memos.
- Bank connection metadata: the Bank Partner you belong to and masked account references.
- Product telemetry: log events, IP address, device/browser data, error reports.
We do not sell personal information and do not use business customer data for advertising.
3. How we use information
- Deliver the invoicing, payments, and reporting features you use.
- Provide the Bank Partner with the reports and dashboards they require to service you.
- Detect and prevent fraud, abuse, and security incidents.
- Improve reliability, performance, and product quality.
- Meet legal, regulatory, audit, and record-keeping obligations.
4. Sharing
- Your Bank Partner. The bank sponsoring your account can access data you generate on the platform to service your account.
- Subprocessors. Infrastructure, database, email, analytics, and AI providers acting under written agreements. A current list is available on request.
- Legal. Where required by law, regulation, or valid legal process, or to protect rights, safety, or the integrity of the platform.
5. Retention
We retain information for as long as your account is active and for the periods required by the Bank Partner's record-keeping and regulatory obligations, after which it is deleted or de-identified. Specific retention windows are documented in the Bank Partner's agreement.
6. Your choices
Depending on your jurisdiction you may have rights to access, correct, delete, or port information about you. Because your bank is generally the controller of platform data, please direct those requests to your Bank Partner. Forthwell Pay uses administrative, technical, and physical safeguards designed to protect information. See our Security page for more detail. No system is perfectly secure.
8. Changes
We may update this policy from time to time. Material changes will be communicated in the product or by your Bank Partner.
